These comprehensive Terms of Sale legally govern all commodity sales contracts and online transaction behaviors between Dalmivo (hereinafter referred to as the Seller) and all individual and corporate customers (hereinafter referred to as the Buyer). By completing website browsing, cart settlement and payment confirmation, the customer confirms that they have fully read, understood and unconditionally accepted all sales clauses, together with our Shipping Policy, Legal Disclaimer, Return & Refund Policy and Privacy Policy, forming the complete legally binding transaction agreement. This document fully complies with French Consumer Code, French Commercial Law, EU Consumer Rights Directive and online e-commerce regulatory provisions.

1. Contract Parties & Contract Formation Rules

1.1 The Seller is Dalmivo, with official business address, contact phone and service email as listed above, acting as the exclusive provider of all website products and sales services. 1.2 The Buyer refers to any natural person over 18 years of age or legal entity with full civil capacity to independently complete online ordering and payment transactions. 1.3 Submitting an order and completing payment constitutes the buyer’s formal purchase offer. The official sales contract is formally established and takes legal effect only after the Seller sends an order confirmation email to the buyer’s registered mailbox. 1.4 Dalmivo reserves the right to conduct order review, identity verification and risk assessment. We retain the absolute right to refuse, suspend or cancel any order with abnormal information, insufficient inventory, suspected fraud, invalid address and violation of platform rules. For all cancelled paid orders, full refunds will be processed through the original payment channel without additional compensation.

2. Product Description & Pricing Specifications

2.1 All product pictures, size parameters, material descriptions, process introductions and functional displays on the website are non-contractual reference contents. Minor color difference, texture deviation and size error caused by shooting and production batches do not constitute product non-compliance or quality problems, and the customer shall not claim compensation for this reason. 2.2 All commodity prices on the website are denominated in Euro (EUR). Prices for orders delivered in Metropolitan France include statutory French VAT. For cross-border EU and international orders, local import tax, customs duty and clearance fees shall be borne independently by the customer. 2.3 Shipping fees are calculated in real time at checkout based on destination, weight and volume, with transparent display and no hidden charges. 2.4 The Seller reserves the right to adjust commodity prices and promotional rules at any time. Price adjustments only apply to new orders and will not affect confirmed paid orders. In case of system technical errors leading to abnormal low prices, the Seller has the right to cancel the order and refund in full.

3. Payment Terms & Transaction Security

3.1 The customer shall complete full payment through legal payment channels displayed on the checkout page. The order will enter packaging and delivery process only after the Seller successfully receives the full payment amount. 3.2 The buyer warrants that all payment information is true, valid and legal, and has legitimate payment authority. Any malicious dispute, unauthorized chargeback or false payment declaration will result in order cancellation, and the Seller reserves the right to pursue legal compensation for losses.

4. Delivery Rules & Risk Transfer

4.1 All order processing, packaging and delivery services are implemented in strict accordance with the official Dalmivo Shipping Policy. All delivery times are estimated values and not absolute guarantees. Logistics delays caused by peak seasons, carrier congestion, customs inspection and force majeure do not constitute Seller breach of contract. 4.2 The customer shall bear full responsibility for providing accurate and complete delivery address, recipient name and contact information. The Seller is not liable for delivery failure, parcel return and loss caused by wrong or missing customer information. 4.3 The product ownership is transferred to the buyer after successful delivery. The risk of product loss, damage and breakage is transferred to the buyer automatically when the parcel is handed over to the third-party logistics carrier.

5. EU Statutory Cooling-Off & Return Rules

5.1 In accordance with EU consumer protection laws, all EU customers enjoy a 14-day statutory cooling-off withdrawal period. The withdrawal period starts from the date the customer receives the parcel, and customers can apply for return and refund without reason within the period. 5.2 To exercise the withdrawal right, customers must send an explicit return application via official email within 14 days, and return the goods in original unused condition with complete original packaging, labels and accessories. 5.3 In line with French and EU legal exemptions, sealed hygiene products after opening, customized personalized products and perishable goods are not applicable to unconditional return. 5.4 Customer-initiated returns shall bear return shipping costs by themselves; returns caused by product defects, wrong delivery and seller errors shall be borne by Dalmivo. Refunds will be completed within 3–7 working days after warehouse inspection and confirmation.

6. Product Quality Warranty

6.1 All products enjoy statutory legal warranty in compliance with French consumer law, covering all verified factory manufacturing defects. 6.2 The warranty does not cover damage caused by artificial misuse, improper installation, unauthorized disassembly and modification, accidental collision, natural wear and tear and failure to follow usage instructions. 6.3 If defective or wrong products are received, customers shall contact customer service within the specified time limit and provide photo evidence. We will provide targeted solutions of replacement, partial refund or full refund according to actual conditions.

7. Intellectual Property Protection

All website trademarks, texts, pictures, designs and creative content are the exclusive intellectual property of Dalmivo. Any unauthorized copying, reproduction and commercial use are strictly prohibited. We will pursue all legal liabilities for infringement behaviors.

8. Liability Limitation Clause

Within the scope permitted by French and EU law, Dalmivo shall not be liable for indirect losses, consequential losses, profit losses and business interruption losses. No clause can exempt the mandatory legal liabilities such as personal injury and death caused by seller’s negligence and fraud.

9. Force Majeure Immunity

Dalmivo shall not be liable for performance delay and service suspension caused by objective uncontrollable factors such as natural disasters, extreme weather, logistics strikes, customs detention and government policy adjustments.

10. Dispute Resolution & Governing Law

These Terms of Sale are governed by the laws of France and the European Union. All disputes shall be settled through friendly negotiation first. If negotiation fails, the dispute shall be submitted to the competent French courts for settlement. EU consumers can also use the official European ODR online dispute resolution platform for out-of-court settlement.

11. Policy Update & Interpretation Right

We reserve the right to update these sales terms in real time to adapt to legal and business adjustments. Updated terms take effect immediately after website publication. Continued ordering means automatic acceptance of the latest clauses. The final interpretation right belongs exclusively to Dalmivo.
